FilesUp (www.filesup.pro) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been uploaded or shared without authorization, you may submit a DMCA Takedown Request following the procedure below.
1. Filing a DMCA Takedown Request
If you are the copyright owner or an authorized representative, you can report infringing content by sending a DMCA notice to our Designated Agent at dmca@filesup.pro with the following details:
- Your Contact Information: Full name, email address, physical address, and phone number.
- Identification of Copyrighted Work: A detailed description of the copyrighted content you claim has been infringed, including the original source (URL or other proof of ownership).
- Identification of Infringing Content: The specific URL(s) on our website where the infringing material is located.
- A Statement of Good Faith: A declaration stating: "I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law."
- A Statement of Accuracy: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Your Signature: A physical or electronic signature.
You can send your DMCA request via email to dmca@filesup.pro. Incomplete or invalid notices may not be processed.
2. Processing of DMCA Requests
Upon receiving a valid DMCA notice, we will:
- Review the claim to verify its validity.
- Temporarily disable access to the reported content while investigating.
- Notify the user who uploaded the content and provide them with an opportunity to respond.
- Remove or restore the content based on the investigation results.
If the content is removed, the uploader has the right to file a DMCA Counter-Notice if they believe the takedown was made in error.
3. Filing a DMCA Counter-Notice
If you believe your content was removed due to a mistake or misidentification, you may submit a DMCA Counter-Notice to dmca@filesup.pro, including:
- Your Contact Information: Full name, email address, physical address, and phone number.
- Identification of Removed Content: The URL(s) of the removed content.
- A Statement of Good Faith: A declaration stating: "I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed."
- A Consent Statement: A statement confirming: "I consent to the jurisdiction of the federal courts where my address is located, or if outside the U.S., the jurisdiction of the courts in which FilesUp operates, and I will accept service of process from the original complainant."
- Your Signature: A physical or electronic signature.
If we receive a valid counter-notice, we may restore the content unless the original complainant initiates a legal action within 10 business days.
4. Abuse of DMCA Policy
FilesUp reserves the right to:
- Reject DMCA notices that are incomplete, fraudulent, or submitted in bad faith.
- Terminate the accounts of repeat infringers.
- Take legal action against those who misuse the DMCA process.
